911. >> this is the victim walking southbound on the shoulder. >> reporter: three officers order the man to drop the gun more than 60 times in english and spanish. the commands so loud. >> there were people on the other side of the sound wall who heard the yelling repeatedly of drop the gun, drop the gun. >> reporter: a witness shared this cell phone video and pictures of officers with their weapons raised. then the man makes a move. >> just before pointing the gun at the officers, he raises it up as if he's inspecting whether or not he has a live round in the chamber. >> reporter: all three officers shot. there were five shots, two of which fatally wounded the suspect. >> they showed a great deal of restraint. >> they did it the way we want it to happen. >> reporter: the inspector with the d.a.'s office says the gun was loaded with a live round in the chamber. in redwood city, abc 7 news. >> if you want to see the full

unedited video of the confrontation, we have a link to it on our website and on the news app. a small grass fire on the shoulder of highway 85 in san jose briefly stopped traffic. sky 7 was overhead a few hours ago as smoke blew across lanes of traffic towards good samaritan hospital. fire crews put out the fire. fire crews who were mowing dry grass in an effort to prevent fires started a fire this afternoon. sky 7 flew over the aftermath. fire crews called for additional help, including water dropping helicopters to put out the flames. heavy smoke is pouring out of the hills and into the sky from the largest of 15 active wildfires burning in california tonight. those bright flames show you that the fire is still growing. air tankers made drops over the

fire today, which is more than 70,000 acres in size. as it burns for a fifth straight day, 1,500 homes are threatened, 45 buildings are destroyed, including a church and school. the fire is 35 files from the park. the park is not in danger of burning and remains open. visitors are being warned about respiratory problems from the smoke. 5,000 people keep in mind are out of their homes tonight and new evacuation orders were issued a few hours ago. we are live in one of those areas with the latest. laura. >> reporter: hi, dan. things are actually improving in some places, but that is at the other end of the fire from where i'm standing as we speak. this fire is still growing at this end as the flames move closer to town. while cal fire has been able to slow the spread of the overall

fire today, it's expected to grow in the days to come. despite an aggressive air attack and the efforts of thousands of firefighters on the ground, the fire continues to grow now consuming more than 70,000 acres and dozens of structures, including this, the 76-year-old little church in the hill in the tiny city. >> it's going to continue to grow. we need people to understand that. this fire is weather driven, it's terrain driven and it's fuel driven. >> reporter: there are at least two dozen homes destroyed by the fire and so far at least two firefighters working on the frontlines have suffered minor injuries. >> it's a mess. one of our friend's just lost their house. >> reporter: many who have lost their homes won't know for a

while as many of the major highways remain closed. this couple were among those turned around. >> we had time to go to the park. >> reporter: a you going to go? >> no, because it will be very dangerous. we decided to go elsewhere. >> reporter: in downtown the owners of this coffee shop came in to check on things and serve a few customers. >> thanks, you guys. >> reporter: coping the best they can with the reality around them. >> i know they'll do anything they can to save town. we've lost our shop before unfortunately about six years ago. >> it burned down. >> very unexpectantly, it came around the corner and the block was on fire. >> the fire came down through the middle of our ranch. >> reporter: mitch and his wife had to evacuate from their ranch. >> it's a difficult time for anybody. this is the worst fire we've ever had and it's nowhere near over yet. >> reporter: you can see a lot of activity where we are. this is what we've been seeing

all day. this is a helicopter that's been making water drops. we've seen those big tankers dropping retardant. firefighters saying they've tried to take advantage of the weather today, cooler temperatures. the winds for the most part have stayed down and the humidity is high. it's supposed to stay that way tomorrow, but the concern is what will happen over the weekend when things are supposed to get warmer and dryer. abc 7 news. >> thank you for that update. as we look live across the bay area, we see mostly blue skies. smoke from the fire has been drifting away from here. we see where it's going. >> i'm going to take you down to the area of the fire and show you current weather conditions. they're still quite warm there. 88 degrees and relative humidity is low. winds gusting to 14 miles an hour. expect winds to diminish overnight to only three or four miles per hour, but the winds will increase again tomorrow

afternoon. the smoke is being blown northward and eastward. smoke covers a wide area right now causing a reduction in air quality. we're mon toriitoring that and fire as well. >> as this fire develops you can keep up with changes. enable push alerts. the smart railroad continues to take passengers on free preview rides in advance of a long awaited revenue service. the drone gives you a view of the system in action, which many thought would be done with testing by now. wayne is live to explain. what's the holdup? >> reporter: the holdup is federal approval of positive train control by the federal railroad administration. what is positive train control? it's almost an automated train that makes it fool proof. no other railroad in america has it. this is the first to be tested

so there's a learning curve on both sides. in the north bay residents and potential commuters have a different appreciation of what it means to wait for a train. >> i have been expecting since last year. >> reporter: a restaurant owner is frustrated by the irregular service of preview trains outside his front door. for months he has waited for an answer to when smart will began regular revenue service. it's been influx. we asked the public information officer, may 12th. >> we don't have a firm date, but we are targeting late spring which is around the corner. >> reporter: we asked a member on june 28th. >> quickly it's going to happen momentarily. >> reporter: we asked the president this morning. >> i will say soon. >> reporter: that was more than good enough for passengers on yet another free preview run today. >> good things you have to wait for, i guess. >> reporter: after a first estimate of revenue service by last november, the railroad

still awaits federal approval of its positive train control system, the first in the america. it will render trains essentially human error proof, but there's been a learning curve. >> we are ready to start service rf . >> reporter: that has not happened yet. more work needs to be done. >> you want to make sure that the train control systems are working properly, that the gates are working properly. >> reporter: sometimes fine-tuning comes down to a few seconds. on june 29th we shot this video of a gate dropping too late after the train had entered the intersection. one growing pain smart has fixed. >> there's no red flags. >> reporter: we asked the question when. >> no date. optimistic will begin soon. >> reporter: which feels like a sound bite round trip. california's attorney general is going to court to try

to block the last independent gasoline terminal in northern california from being sold. he believes the sale will lead to higher gas prices for consumers. abc is live with the story. leslie. >> reporter: this huge shipping terminal here is behind me a vast network of pipes and 31 tanks. it's owned by a company called plains all american. there is a deal to buy it and that worries the california attorney general. >> anti-competitive behavior is never good for consumers. >> reporter: the california attorney general says the company is looking to buy the last independent terminal in northern california that distributes gasoline to all the retail stations. he says the other terminals are already owned by refiners and he fears the sale could affect the prices the consumers pay at the pump. >> it could be that the suppliers can manipulate the

supply to dictate the price of gasoline. that is not good for california families. >> reporter: on monday the attorney general will file an injunction to prevent the sale from moving forward. an emergency attempt to block the transaction was already turned down by a u.s. district court judge last week. >> california prices are over 60 cents above national average, when only about 30 to 35 sepcen is explainable through higher taxes. >> reporter: this price expert says the differential amounts to $4 billion a year for consumers. the smaller richmond terminal that's part of the sale is not part of the dispute, only the gigantic martinez terminal that handles crude for bay area refiners. when contacted, valero reissued a joint statement put out by their ceo last week saying as

after serving nine years in prison, o.j. simpson has been granted parole. we sent a push alert after the board of parole commissioners made its decision. simpson could be released as early as october 1st. he was sentenced to 33 years in prison after a botched robbery at a las vegas hotel. simpson said the items belonged to him. >> i am sorry that things turned out the way they did. i had no intent to commit a crime. >> prison officials will work on developing a release plan. simpson is requesting to live in florida where his family is. abc 7 news spoke to a legal expert who said he was not surprised by the decision. >> under the rules of the parole board and watching his

testimony, that seemed to be the logical conclusion. >> simpson was born and raised in san francisco before making it big in the nfl. some of the bay area residents we spoke to were surprised by the decision based on simpson's history. >> people often still hold him responsible for a crime he was acquitted of and i think that's why people don't want him to get paroled. >> he's referring to the murders of simpson ex-wife and friend. simpson was acquitted, but found liable in court. senator john mccain has been diagnosed with an aggressive incurable type of brain cancer, but he will soon be back in washington. the tumor was discovered after a surgery to remove a blood clot. it's a grade four cancer. that's the highest on the scale. for men over 50 the recovery rate over five years is 5%.

senator mccain's illness underscores the need for cancer drugs, but there is a shortage of seven cancer drugs due to limited production capacity. an effort is under way in the bay area to try to limit that. >> reporter: about 400 of the more than 1,200 drugs in development at firms in california focus on cancer. this company develops and manufactures some of them and it's expanding capacity by 1/3. for years cancer patients and doctors have faced a shortage of supplies of oncology medicines. in some cases patients have to wait months if not longer to get medicines. this facility is going to try to address that shortage. cell technology is expensive. the state of california is providing $25 million in tax incentives. for patients whose lives are on the line, increasing drug

production has no price tag. >> there are several drugs that they're working on, both in our inhouse research and also from external partners and at least two of which have potential to also treat the brain cancer that john mccain suffers from right now. >> reporter: no jobs will be created, about 300 over the next two years, although much of the cell cultivation is automated, human intervention is needed. >> we need to feed them nutrients and remove waste products and as they grow and produce the medicine itself. >> reporter: the increased capacity will benefit other companies that utilize this facility. abc 7 news. we are getting pretty close to the weekend. >> we are. so what's the weather going to be like? here is the forecast. >> i'll end the mystery. we have a weekend warmup coming

our way. we're going to use antioch as the example. high tomorrow it will be 92 degrees, but on saturday 100 degrees and 98 on sunday. that's indicative of what most inland areas can expect over the weekend. early next week we'll see temperatures drop into the low 90s before bouncing back later in the week. you can see we have sunny skies across the bay area. no evidence of the marine layer except for a patch of light low clouds developing along the coast line there. blue skies over san francisco. it's currently 62 degrees here in the city and in mid 70s and 61 at half moon bay. check out this view. looking at the golden gate. it's clear there. current temperature readings up in santa rosa at livermore and this is how the

coastline looks. almost no evidence of a building marine layer. we'll have our warmer pattern beginning tomorrow. temperatures up to 100 degrees or higher in some inland locations this weekend. it will be bright and mild at the beaches. forecast animation shows a development of a light layer of low clouds and fog along the coastline overnight. it will dissipate tomorrow during the day time. morning lows will be in the mid to upper 50s. it will be mild overnight and tomorrow. low to mid 60s at the coast and upper 80s to low 90s in our inland areas. as we look at the beach forecast, you'll see partly sunny skies tomorrow and high temperatures in the 60s. and it will be an extremely high uv index so be sure to take the sun screen along if you're going to spend time in the sun, not just at the beach but anywhere. here is the seven-day forecast.

a tweet sent by tesla got the internet buzzing today. he said he's been given the green light by the government to start building hyperloop which super fast transportation through a tunnel. >> the bay area is part of the plan. we have the story about impact. >> reporter: cars can glide smoothly at airline speeds. hyperloop is fast. the concept that a handful of companies are taking on, but it was tesla who sent the internet into a flurry when he tweeted, just received verbal government approval for the boring company to build a hyperloop. >> it's up to elon to show the world that it will work.

god bless him if he can. he's done it before. >> reporter: musk has shown off a drill that's being used to bore a tunnel in l.a. it's an effort to show that tunnels are the future of transportation. hyperloop is part of the solution. in a follow up defeat, he addressed the west coast saying tunnels would be built to alleviate guesten. >> if there are ways to help us throughout the state, good. >> reporter: musk needs to prove his technology will work. >> you're talking about a technology that's going to go 700 miles an hour. it's never been done on the surface of the earth. >> reporter: musk says more work needs to occur for formal approval, but he's optimistic it

>> i feel she chose us. >> reporter: they met her for the first time last night. >> as i saw them come ouing out the gate, i was like oh my gosh. >> reporter: micah had a rough start in life. at three months old she was stabbed in the eye and she was shuttled from home to home until a volunteer realized san francisco might be a perfect place. >> i think it's a great place for a dog to live. >> reporter: this woman volunteers for the shelter. she posted the story on monday night hoping to find her a home and it worked. >> i saw the post and said this dog from tennessee with this horrible story has to be my dog. >> reporter: less than 24 hours later adoption papers were signed and dozens of people chipped in to buy a plane ticket

to help escort micah on the plane. >> it is amazing, but it doesn't surprise me coming out of san francisco. there's big hearts here. >> reporter: micah is loving her new backyard. dogs often stay in shelters for more than a year in tennessee so this was an opportunity to save a life and a small san francisco community agreed. in san francisco, abc 7 news. the lead singer of the band lincin park has died. he was found dead in his home in los angeles this morning. the singer struggled with drugs and alcohol for years. he was very close with sound garden singer chris cornell who hanged himself in may. this is video. today would have been his 53rd birthday. at least seven people need to find a new place to live for the time being after a fire drove them from their homes in

oakland. scene posted on twitter. it broke out in a building at 10:45 this morning. no one hurt in the fire, but a dog did die. one person went to the hospital following a fight at the scene. investigators don't know how the fire started. abc 7 news was at berkeley campus because someone saw a mountain lion east of that campus around noon yesterday. this is the latest mountain lion sighting in the past few years. mountain lions hunt deer and deer live in the hills above berkeley. a mountain lion was spotted today around noon. the animal was seen in a backyard on view ridge drive. mountain lions have been seen there before. there's a lot of confusion in communities across the bay area as folks maybe you find out that their energy is no longer coming from pg&e but a new energy supplier. >> michael finney has more.

>> pg&e is delivering the power. they're just not the providers of the power. it gets really interesting. i've told you about these new community run utilities that pledge to deliver cleaner energy than pg&e. they are operating in several cities. thousands of san francisco residents are finding out they were automatically enrolled in a clean energy program too. the postcards are just now arriving at san francisco homes about understanding your energy choice. >> people are surprised because evidently the disclosure has failed. >> reporter: consumer action says customers didn't realize their power is supplied by clean power sf. communities can create their own clean energy utilities. residents are automatically enrolled unless they specifically opt out. >> that is going to frustrate

consumers and anger them if they feel like they didn't have a fair say. >> reporter: advocates say it's the only way to get enough customers to buy power like solar and wind at low enough rates. >> the only thing that changes is that we're putting cleaner energy into the grid and they deliver it to residents. >> reporter: clean power sf is currently a little cheaper than pg&e and it's being phased in gradually. >> going forward through 2018 and 2019 we expect to enroll all eligible electricity customers. >> reporter: many are caught by surprise in spite of a vigorous ad campaign that includes these billboards and four mailers. also, pg&e put out that postcard comparing their rates with pg&e the average monthly electric bill is wurcurrently $64.70. with clean power sf it's seven cents less.

sears and amazon are partnering up. sears will sell appliances on amazon.com. customers could say turn down the tehermostat. sears department stores have been struggling for years and this could help turn things around. after the closing bell, sears stock climbed for than thn 10%. more american households are renting than at any point in the past 50 years. that's according to new analysis. you can see the percentage of renters dropped in the years leading up to the recession and the numbers have gone up ever since. more than one-third of households rent nearly matching the number from the mid 60s.
